The appeal was dismissed because there was no mutuality between the allocaturs in favour of the plaintiff (debts against the bankrupts) and the costs claimed by the trustees (debts owed to the trustees in their capacity post-bankruptcy), and because the plaintiff failed to prove that the estate had paid or been subrogated to the allocatur amounts; accordingly set-off was not available and the lifting of the stay was upheld.
