Leave to appeal refused because the appellant's complaints attacked the adjudicator's factual findings without raising any question of law or showing excess of jurisdiction under Cap.338 s28; the adjudicator's conclusions were supported by the evidence and there was no procedural unfairness.

The Magistrate properly accepted the sole prosecution witness as credible, accepted the photograph and admitted facts, and on that evidence the only reasonable inference was that the tables and chairs on the pavement formed part of the appellant's food business; the appellate court will not disturb such factual findings and inferences, therefore the conviction is upheld.

The appeal is dismissed because the Deputy Adjudicator acted within his discretion in attaching little weight to an unsworn statement not tested by cross-examination and his factual finding that the payments were personal loans is supported by evidence and not open to appellate challenge under the Small Claims Tribunal Ordinance.

The particulars, read as a whole, fairly alleged a conspiracy to engage in bookmaking; the references to "assist" related to the computer's function and not to a distinct offence of assisting others; omission of the phrase "by way of trade or business" in the particulars did not prejudice the accused given the detailed factual allegations; a conspiracy may encompass agreements to commit more than one closely related offence under s159A(1); the trial judge made adequate findings on evidence and his conviction on the conspiracy count was safe.
