The court accepted the plaintiff's contemporaneous contracts and receipt, rejected the defendants' unsupported assertion of a HKD300,000 full and final settlement and refused late applications to file a contradictory payment confirmation or to amend the defence because of unexplained delay and prejudice to the plaintiff; accordingly the defendant that contracted to repay was held liable for HKD334,500 less the HKD50,000 paid, plus interest as calculated by reference to the agreement and thereafter by judgment interest.
