The magistrate correctly exercised his discretion under s.48 to order forfeiture because the claimant failed to demonstrate undue hardship or any factor sufficient to displace the statutory presumption of forfeiture; the owner's limited personal use and lack of driving licence did not negate the inference that the convicted driver used the vehicle nor did those facts amount to undue hardship warranting non-forfeiture.
