The court held the foreign notarised affirmations were admissible, accepted the evidence of service on 3 November 1994 and, on the totality of facts (implausible agreements, unusual completion in Singapore, dubious disbursement of proceeds and communications making notice likely), concluded the respondent had notice of the February Mareva injunction when completion occurred and therefore was in contempt; the application to discharge was dismissed and a six month custodial committal with liberty to apply was imposed, purgeable by returning the sale proceeds of HK$1,350,000.
