The conviction was unsafe because the jury were misled about the burden of proof by a s.37K certificate that referred only to 25 October while the charge alleged 24–25 October, combined with the trial judge's failure to direct the jury to evaluate the alibi evidence against the possibility of the defendants' participation in the voyage; these defects rendered the verdict unsafe and required quashing of the conviction.
