On the evidence the court found the joint account was opened with a survivorship provision and meant as a gift to the defendant: the deceased never operated the account, the survivorship instruction was explicit and the defendant's account of events was credible; the memorandum did not admit the account formed part of the estate; the 1st plaintiff's conduct constituted harassment and private nuisance; accordingly the plaintiffs' action was dismissed and the defendant's counterclaim succeeded, yielding injunctions and assessed damages of HKD 30,000.
