The appellate court, conducting a rehearing, accepted the trial judge's credibility assessment of PW1 and the finding that the appellant struck the motorcycle from behind; it held the magistrate was entitled to treat the appellant's uncautioned spontaneous statements as admissions and to give them significant weight, and that the post‑verdict review to consider the appellant's lack of prior convictions did not create procedural unfairness; therefore the evidence proved the offence beyond reasonable doubt and the conviction is upheld.
