The pleaded claims were scandalous, frivolous and vexatious and lacked any solid factual foundation; key allegations (dishonesty, misuse of documents, breach of natural justice, coercion to adopt the new Ordinance without Schedule 2, and conflict of interest) were demonstrably unsupported by contemporaneous documents or testimony and, together with multiplicity of proceedings, amounted to abuse of process. Accordingly both statements of claim must be struck out and the actions dismissed; interlocutory remedies are academic and costs are reserved for further submissions.
