Appeal allowed because the magistrate's critical finding that the intermediary loans were sham contradicted the statement of agreed facts entered under s.65 of the Criminal Procedure Ordinance; without a sustainable finding of sham the transactions could not be treated as an "advance" under s.22 and related convictions under ss.22 and 31 could not be upheld.
