On the evidence and proper interpretation of documents and the Deed of Gift, the court found that the Happy Valley and Lantau properties were held for the public charitable purpose of advancing Buddhism (thus outside the deceased's estate) while the Nathan Road property failed the criteria for a public charity and forms part of the deceased's estate; expert evidence on religious practice was not determinative and the burden lay on D1 to prove any beneficial interest.
