Because the defendant was a party to the registered DMC, its alleged adverse possession of the lane does not defeat the incorporated owners' equitable right to enforce the covenants in the DMC or the obligations under the BMO; accordingly the incorporated owners were entitled to default judgment and the defendant's application to file a defence and counterclaim out of time was dismissed.
