The court held that the 2012 brochure, distributed in Hong Kong and showing BEMO (including in combination as HELMED BEMO with BEMO capable of independent distinctive function), constituted genuine use of the Subject Mark in Hong Kong during the relevant period, thereby reversing the Hearing Officer's revocation and dismissing the revocation application.
