Given the defendant Leung's earlier representation that records were available and the subsequent limited production and inconsistent affirmations, the court ordered that Leung and the Company must file a further particularised affirmation for each category of documents stating existence and whether in their possession, custody, power or control, identify all company bank accounts and either obtain and produce bank statements/cheques or provide authorised instructions to banks to supply them to the plaintiff within 28 days; costs awarded to the plaintiff on a party-and-party basis.
