Hong Kong is the natural and appropriate forum because the subject matter (CSI shares and related contractual/proprietary rights) has its situs and substantial connections in Hong Kong, related receivership and litigation are in Hong Kong, and PRC remedies are ineffective; the Jinan proceedings were found to be frivolous, vexatious, unconscionable and commenced to facilitate a governmental takeover through coercion and collusion and were therefore restrained by an anti-suit injunction in favour of the Plaintiff.
