The court found that the plaintiffs failed to prove adverse possession of the 1st Land or the alleged 1997 instruction and acceptance by D; D had exercised exclusive possession from about 1977 (and/or held paper title by assignment) and the $50,000 payment was not shown to be contribution to legal costs for a family claim; accordingly plaintiffs' claims fail and D is entitled to rely on his possessory/paper title and counterclaim.
