The Court accepted the Magistrate's findings that Christine was the controlling mind of ACL and Ho acted as agent, that the WhatsApp evidence and oral testimony showed the appellant knew Christine had decision-making authority and sought Ho's intervention; the Magistrate's credibility findings were not plainly wrong; therefore the convictions under s9(2)(a) were upheld; sentencing was reduced only to the extent that the two custodial terms should run concurrently, resulting in a single 4-month immediate custodial term.
