The tenant was contractually obliged to pay rent into the landlord's specified account and was duly notified; mistaken payments to the former agent do not discharge that obligation; the respondent failed to establish any legal duty owed by the current agent that would justify apportioning the loss; accordingly the respondent must pay arrears of HK$103,000 and deliver vacant possession, with mesne profits at the contractual monthly rate until delivery.
