The applicant's appeal succeeded because the court found his culpability lower than that of the burglars: he was not a fence nor a sharer in the goods and was recruited after the burglary to assist in moving the safe. The appropriate starting point was 3 years (not 3 years 6 months); applying one-third credit for guilty plea yielded a 2 year sentence. The original sentence of 2 years 4 months was set aside and substituted with 2 years imprisonment.
