The Court allowed the appeal, holding the trial judge erred in finding the defendant liable for aggravation because the plaintiff failed to plead or prove a legal basis (negligence, non-delegable duty or vicarious liability) for such liability and the employer reasonably relied on the panel doctor's advice; accordingly the trial judgment awarding damages for aggravation was set aside.
