The appeal was dismissed because the Defendants disclosed at least one decisive and otherwise well‑founded limitation defence in light of the Privy Council judgment in Lam Island permitting a 20‑year period to straddle 1 July 1973; alternatively the defendants raised arguable equitable defences (part performance applying to s.3 and aggregation of successive possession) warranting trial, so the Master’s order setting aside the default judgments was properly left in place.
