On the balance of probabilities the court found the parties reached an agreement in July 2013 that the defendant would marry the plaintiff in return for payments (treated as betrothal/ marriage gift); the payments of HK$120,000 were made in contemplation of marriage and therefore were conditional gifts; because no marriage occurred the defendant must repay the funds with interest; this conclusion was supported by contemporaneous WhatsApp messages, bank transfers, the purchase of a gold bangle as a betrothal token, and the court’s adverse assessment of the defendant’s credibility and alternati…
