On the facts the plaintiffs had provided specific funds for costs, fully itemized bills were delivered at times of natural breaks in the litigation and the solicitors deducted the billed amounts from those funds contemporaneously with delivery; the plaintiffs, being a substantial commercial entity with access to advice, acquiesced which amounted to an agreement; therefore the deductions constituted payment and/or separate final bills under Romer v Haslam, so the proviso to section 67 did not permit taxation and the master's order for taxation in respect of the two bills is set aside.
