The Court held that the agreement of 18 April constituted entitlement to payment in lieu under s31E, removing the basis for treating the employee as laid off under s31B; s31E must be read to require either 12 normal working days provided in any four-week period or payment in lieu, and where payment in lieu is agreed the employee is not deemed laid off, so the lower court's judgment for the plaintiff was set aside.
