Given the admitted facts and mitigating features (no relevant prior convictions, kinship and provision of necessities), and having regard to established sentencing approach for such offences, the appellate court reduced the sentence to permit the appellant's immediate release while not criticising the magistrate's exercise of discretion.

The Full Bench held that the decision in Lo Pui-ling was misapplied; section 38(1)(b) is to be understood as creating a continuing offence while the immigrant remains within the limitation period and the facts did not show the applicant was convicted of a non-existent offence; therefore the application for certiorari was refused.

The magistrate's fine was manifestly inadequate for the offence; on review the Court substituted a custodial sentence of two months' imprisonment because the offence ordinarily requires immediate custody and the respondent must have known the conduct was illegal.
