The court held that the contents of the PRD Plan were not necessary for the fair disposal of the discovery application because the EIA Report, the NATS Phase 2 Report and the evidence already filed permitted determination of the applicant's complaints about assumptions and disclosure; further, even if production were necessary, the Chief Secretary's certificate established that disclosure would cause substantial harm to inter-government trust and PRD aviation cooperation and involved matters beyond judicial experience, so public interest immunity must prevail and production was refused.
