The application to adduce further evidence was dismissed because the first Ladd v Marshall condition failed—the Jack invoices were produced well before trial and the plaintiff or his advisers saw the orientation issue at trial so the expert reports could have been obtained with reasonable diligence—and because the second condition failed—the proposed evidence was peripheral and would probably not have an important influence on the outcome given the judge's findings that the I_MY invoices were contemporaneous and delivered.
