The court refused to vary the prior costs order nisi because the original decision had properly considered the Official Solicitor's involvement and the centrality of the loss of earning capacity issue which brought the case into High Court jurisdiction; artificially filleting discrete issues for further cost-shifting would be contrary to the objectives of Order 1A and disproportionate given the short hearing. Therefore the order that the 1st and 2nd Defendants bear 50% of the costs of the 29 April 2009 hearing (with no order as to the remaining 50%) was made absolute.
