The Court refused the extension of time because the delay was unexplained and, on the merits, there were no reasonable prospects of success: the Judge’s factual finding that Cheung, as sole shareholder/director and controlling mind, funded and stood to benefit from the defence was open on the undisputed evidence, the Judge did not err in law or principle in ordering non-party costs and bad faith was not required to support such an order when personal benefit was shown.
