The deputy magistrate did not err in treating the accused's failure to make immediate complaints as admissible and relevant to the limited issue of whether the alleged confessions were voluntary; the magistrate's findings were supported by the evidence as a whole and the applicant's contentions were not reasonably arguable, so leave to appeal was refused.

The magistrate erred by making an actual finding that the appellant had made the admission at the admissibility stage rather than assuming it had been made; because the Record of Interview was the sole evidence against the appellant and she denied it, the error was material and rendered the conviction unsafe, warranting allowing the appeal; after balancing factors a retrial was refused.

Because the Magistrate's intervention and phrasing likely caused the appellant to believe he should admit possession (rather than clearly informing him he could refuse to admit), combined with confusion over exhibit identification making the admission equivocal, the conviction could not stand as justice was not manifestly seen to have been done; appeal must be allowed and conviction quashed.
