The Court allowed the appeal because the issues in the amended notice arose out of the original application (and, even if they did not, an extension of time should be granted), therefore permitting the applicant to proceed with the application for leave to apply for judicial review.

The Court allowed the appeal, holding that there were sufficient merits to grant leave to apply for judicial review (including leave to amend the application) and that an appeal against refusal of leave is interlocutory under the application test because the grant of leave does not finally determine rights between the parties.
