The Court held that Part II protection under the amended Ordinance applies only to tenancies that were still subsisting on 18 December 1979; a fixed three-year tenancy that expired before that date and where the occupier remained in possession against the landlord's will does not become a protected tenancy by virtue of the retrospective commencement provision.
