TANG SIU CHUNG v. THE HONG KONG SOCIETY FOR THE DEAF AND OTHERS
- Citation
- [2023] HKCFI 2006
- Court
- Court of First Instance
- Case number
- HCMP1223/2021
The Bye-law, read by its plain language, prevented re-election of council members who had served 30 years or more in aggregate so Lui was ineligible and the 51st AGM was procedurally tainted by the lack of assurance that Tang's objection would have been dealt with; however the irregularity was cured by the subsequent informed 2021 meetings which re-approved the appointments, rendering the claims academic, and therefore the Originating Summons was dismissed with costs awarded to the Society.
