The court held that deterrence and protection of public health justify suspended custodial sentences for proprietors who persistently breach the prescription regime, but that a probationary salesman with a clear record should not attract suspended imprisonment; accordingly the 2nd Appellant's suspended terms were reduced (charges 2 and 3 from 4 to 2 months; suspended sentence removed for charge 1) while fines were retained, and the 1st Appellant's suspended sentences were quashed leaving fines intact.
