O.59 r.13(1) cannot be applied to negate the substantive effect of section 42; the applicant failed to prove it received the payment in good faith and without notice of the appeal and failed to rebut the presumption that the disposition prejudiced the general body of unsecured creditors; accordingly the court refused to validate the HK$3,000,000 disposition and dismissed the summons.
