Appeal for leave
  • 19 Dec 2019

    梁妙儀 對 嶺南大學

    Citation
    [2019] HKCFI 3088
    Court
    Court of First Instance
    Case number
    HCLA25/2017

The leave application was out of time (deemed service 16 Sep 2017; application filed 26 Sep 2017) and, independently, had no arguable merit because the employment contract expressly authorised termination during the probationary period on one month's notice or payment in lieu which the respondent paid; therefore there was no basis to overturn the tribunal's decision and the leave application was dismissed.

    HKSAR v. TAM CHI HANG

    Citation
    HKSAR v. TAM CHI HANG
    Court
    Court of Appeal
    Case number
    CACC475/2003

The court held that, viewed in full context, the trial judge's remark that the evidence 'looked overwhelming' was a qualified observation based on a summary, did not amount to bias or prejudgment, and did not render the trial unfair; the judge's interventions were bona fide and within permissible bounds; the evidence supported inferences of possession, knowledge and use to produce infringing copies; the ancillary points about a missing key and interpretation of photographs were insufficient to undermine the safety of the conviction. Accordingly leave to appeal was refused.
