The Court held that the PIC acted beyond its statutory powers by revising and preferring charges after it had considered the complaints and determined that no inquiry should be held; that procedural non-compliance with the Regulations rendered the subsequent Dental Council inquiry and findings void; accordingly the appeals were allowed and the Dental Council’s decisions quashed. The Court left open the substantive question whether the appellants’ conduct amounted to unprofessional conduct.
