The appellate court, conducting a rehearing, accepted the prosecution witness as credible, found the appellant could and should have seen that the way ahead was clear before entering the yellow box, rejected the asserted obstacle excuse, and concluded the evidence proved the offence beyond reasonable doubt; appeal dismissed and conviction upheld.

Trial judge's acceptance of the complainant and supporting witnesses, together with CCTV footage and contemporaneous conduct, proved the indecent assault beyond reasonable doubt; appellant's repeated offers of substantial money to complainant and husband, made when police had been alerted, were deliberate acts with a tendency and intent to procure their abandonment of prosecution and therefore constituted obstructive conduct; appellate re‑hearing reached same conclusions and dismissed appeal.

The High Court reheard the matter and concluded the magistrate's starting point of 24 months' imprisonment was appropriate given the low quality of the single counterfeit HK$1,000 note, the summary jurisdiction limit, and mitigating factors (single note, willingness to compensate), while recognising prior similar convictions and prompt reoffending as aggravating factors; after one‑third guilty‑plea discount the final sentence of 16 months and a compensation order of HK$900 were not manifestly excessive, so the appeal is dismissed.

The convictions were quashed because the magistrate's sole finding of careless driving rested on a misapprehension of the road layout and traffic light relevance and upon inadmissible lay opinion evidence from an unqualified police witness; there was insufficient admissible evidence that a collision causing damage occurred or that the appellant knew of it, so the offences were not proved beyond reasonable doubt.
