Detention under section 32(3) remained lawful because the applicant had previously withdrawn his non-refoulement claim so section 37Z did not bar removal, the Director acted with diligence to effect removal, the period of detention (115 days) was reasonable in all the circumstances, and significant delay and impediment to removal were substantially attributable to the applicant's own conduct and the risk of absconding and reoffending justified continued detention.
