The Company was shown to be impecunious (significant balance-sheet deficit) and its appeal, while arguable, lacked sufficiently strong prospects to outweigh the risk of non-enforcement of costs; consequently it was just to order security for costs from the Company in specified sums, with failure to provide security resulting in dismissal of the appeal.
