Leave to appeal was refused because even if a jurisdiction to review a first instance judge's referral to the DPP exists, the referral was effectively irreversible and there was no practical benefit to granting leave; significant corrective orders and restrictions had already been made (forgery findings set aside, DPP's use restricted, privilege issues remitted) rendering the application academic and an inappropriate use of this Court's leave jurisdiction, and the Court of Appeal's characterisation of referrals as not appealable in the circumstances was not shown to warrant leave.
