The Full Court found there was sufficient evidence of a contract of service: the respondent exercised a real measure of control (instructions on delivery, vehicles and number of coolies), the appellant was not operating as a business on his own account (no realistic possibility of loss), and the remuneration system did not negate employment. Accordingly the appellant was a 'workman' under the Workmen's Compensation Ordinance and entitled to compensation, which the court awarded and quantified without ordering a retrial.
