By a majority the Court applied Article 12(1) broadly to the underlying facts and held that although the statutory scheme was amended to create lighter maximums for mere possession, the facts established the specific intent required for the higher maximums in the replacement provisions (ss.75(1) and 76(1)), therefore the appellant was not entitled to the lighter penalty and the district judge's sentences were upheld.
