The court found the patient was mentally incapacitated and, applying the paramountcy requirement of Section 10A(2) and proportionality in protecting the patient's estate, concluded that appointing the Official Solicitor as committee best served the patient's interests by avoiding a costly trial that would deplete the estate; accordingly the Official Solicitor was appointed despite the wife's objections.
