On a fair purposive reading of the Basic Law the legislature of the HKSAR may enact deeming provisions to treat the defined Mainland Port Area as outside Hong Kong for specified law and jurisdictional purposes to implement a co-location immigration/clearance scheme; any ambiguity is resolved by the NPCSC Decision which is entitled to significant weight; accordingly the Ordinance is consistent with the Basic Law and the substantive judicial review challenges fail.
