By majority the Court held Omar's evidence was admissible as relevant to state of mind/intent and not solely impermissible propensity evidence, the judge's directions were adequate, and the forensic evidence (DNA, fingerprints, fibres) provided overwhelming support for a murder conviction; accordingly leave to appeal was granted but the appeal against conviction was dismissed.
