Majority: Although the prosecution's failure to disclose that PW1 had lodged an extant petition for remission was a material irregularity, the nondisclosed material did not produce a miscarriage of justice on the whole of the evidence and having regard to the judge's detailed findings on credibility and the surrounding primary facts; therefore the proviso in s.83(1) CPO applies and the convictions are safe and must be upheld.
