Applicant's prior statements and solicitors' certificate established impecuniosity; applicant failed to produce admissible evidence on customary law and did not demonstrate sufficient countervailing factors or a strong likelihood of success on appeal; on that basis and after moderating the respondents' claimed figure as excessive, the court ordered security for costs of HK$450,000 to be paid into court within 28 days and stayed the appeal pending payment, failing which the appeal would be dismissed.
