The master’s refusal was set aside because the correct test for admitting an expert report without calling the expert is relevance and probative value; Dr Chan's orthopaedic report was relevant and probative to assessing the plaintiff's neck and back impairment even though it did not reference an earlier accident or define terms, and thus it could be adduced without oral evidence.
