The Court held that there was no evidence of forum shopping and dismissed the leave application against Yam J's order reserving the quantum hearing to him, but granted leave and allowed the appeal against Yam J's order of 12 January 2010 bringing the hearing forward to 18 January 2010 because the short notice caused unacceptable prejudice and denied adequate warning; accordingly the bringing-forward order was set aside.
